Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Truckers BSwebsite, applications, and related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By accessing or using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. We may update these Terms from time to time as described in Changes to These Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is accurate and current.

3. Accounts & Registration

• You are responsible for maintaining the confidentiality of your account credentials;
• You are responsible for all activity that occurs under your account;
• You agree to provide accurate information and to keep it up to date; and
• You must notify us promptly of any unauthorized use of your account.

4. User Content & License

"User Content" means any stories, articles, photos, videos, comments, load postings, portfolio entries, messages, documents, and other materials you submit to the Platform. You retain ownership of your User Content.

By submitting User Content, you grant Truckers BS a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, publish, and distribute that content for the purpose of operating, promoting, and improving the Platform. For content you choose to publish publicly, this includes displaying it to other users and the public.

You represent and warrant that:

• You own or have the necessary rights to your User Content; and
• Your User Content does not infringe the rights of any third party or violate any law.

5. Acceptable Use

You agree not to:

• Post content that is unlawful, defamatory, harassing, hateful, or fraudulent;
• Impersonate any person or entity, or misrepresent your affiliation;
• Upload viruses, malware, or otherwise interfere with the Platform's operation;
• Attempt to gain unauthorized access to accounts, systems, or data;
• Scrape, harvest, or collect information about other users without consent;
• Post false, misleading, or fraudulent load postings or business information; or
• Use the Platform for any purpose that is illegal or prohibited by these Terms.

6. Contributor Program & Payments

Approved contributors may publish long-form stories and other content and may be eligible to receive payouts. Eligibility, payout amounts, and payment schedules are determined by us and may change at any time. You are responsible for any taxes arising from payments you receive. We may withhold or reverse payments for content that violates these Terms.

7. Paid Services (TBS Plus & Promotions)

Certain features, including TBS Plus promotional packages, are offered as paid services. Pricing for these services is provided on request by contacting our team. Fees, once paid, are non-refundable except where required by law or expressly stated otherwise. We may modify or discontinue paid services at our discretion.

8. E-Signature Feature

The Platform offers tools to send, sign, and store documents electronically. You are solely responsible for the content, accuracy, and legal validity of documents you send or sign. Truckers BS provides these tools "as is" and does not provide legal advice or guarantee that a given electronic signature is enforceable in your jurisdiction.

9. Intellectual Property

The Platform, including its design, logos, text, graphics, and software (excluding User Content), is owned by or licensed to Truckers BS and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written permission.

10. Third-Party Links & Services

The Platform may contain links to, or integrate with, third-party websites and services (such as Google, Stripe, and partner creators). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms.

11. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that content is accurate or reliable.

12. Limitation of Liability

To the maximum extent permitted by law, Truckers BS and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Truckers BS and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Platform, or your violation of these Terms or the rights of any third party.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any other reason. You may stop using the Platform and request account deletion at any time. Provisions that by their nature should survive termination will continue to apply.

15. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Truckers BS operates, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Platform will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.

16. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
